Social Security Disability Attorneys Serving Massachusetts, Rhode Island and New Hampshire
To be eligible for Social Security Disability Insurance (SSDI) benefits, you must have a physical disability or mental disability, or a combination of the two, that is expected to significantly impair your ability to work for at least 12 months or which may result in death.
The key word is expected. You do not have to be out of work for 12 months before applying for benefits. If your disability is expected to impair your ability to work for more than a year, you may be eligible to receive benefits.
The term disability refers to any injury, illness, physical impairment, brain impairment or mental disability that may significantly impact your ability to work. Visit our sections on physical disability and mental disability to learn more about specific conditions that may qualify you for SSDI benefits.
Work Impairment
To receive SSDI benefits, you must show that your ability to work has been significantly impacted by your physical and/or mental disabilities. Unfortunately, it is not enough to show that you are unable to return to your previous place of employment. You must be able to show that you are unable to maintain employment in any job or profession.
If you previously worked in construction, for example, but now are unable to perform necessary work duties because you have severely injured your back, your application for SSDI benefits will still be denied if it is determined that you could find an office job that is not as physically demanding. However, your education, previous work experience, age and other factors will be taken into account, along with the impact of your physical or mental impairments, to determine if you are able to maintain gainful employment.
